11. Imagery
By uploading any imagery to the FETCHevery software, you agree to the following:
a. Legal and Appropriate Use: You warrant that any imagery uploaded complies with all applicable laws and regulations in the countries in which you operate. Furthermore, you agree that the imagery will not be used for illegal, inappropriate, or unethical purposes, including but not limited to bullying, harassment, or discrimination.
b. Copyright Ownership: You guarantee that you own the copyright for any imagery uploaded to the software or have obtained the necessary permissions or licenses to use such imagery. You agree to indemnify and hold FETCHevery harmless from any claims of copyright infringement arising from your use of the software.
c. Permission for Verification: You grant FETCHevery permission to review and verify any imagery uploaded to the software to ensure compliance with these terms and conditions. This verification may be conducted manually by our team or through automated means, including but not limited to the use of artificial intelligence algorithms.
d. Compliance Assurance: You acknowledge that FETCHevery reserves the right to remove any imagery that violates these terms and conditions or any applicable laws, regulations, or policies. Failure to comply with these requirements may result in suspension or termination of your subscription without prior notice.
12. Limited Liability and Refund Policy
a. Limited Liability: FETCHevery‘s liability to you is limited to the amount you have paid for the subscription services during the previous month preceding the event giving rise to the claim. In no event shall FETCHevery be liable for any indirect, incidental, special or consequential damages, including but not limited to loss of profits, revenue, or data, arising out of or in connection with your use of the software.
b. Contract Cancellation: You have the right to cancel your subscription contract with FETCHevery within 14 days of the contract starting, provided that notice is given in writing. After the initial 12 months, you can cancel but must give 2 months’ notice in writing. Upon cancellation, your access to the software will be terminated, and you must cease all use of the software and delete any copies in your possession or control.
